SMS Terms and Conditions

IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN FOCUS FEATURES TERMS OF USE WHICH ARE INCORPORATED AS IS FULLY SET FORTH HEREIN. PLEASE READ CAREFULLY.

Focus Features, its parent company NBCUniversal Media, LLC (“Focus Features,” “NBCU,” “company,” “we,” “us,” or “our”) provides these SMS Terms and Conditions (the “SMS Terms”), which govern the provision and delivery of text messages by us or our text message service providers to you. Depending on how you subscribe to our text messaging service, Focus Features provides this text message service to: (1) provide you with information you requested from company, such as marketing updates, and/or (2) inform you of company products, surveys, newsletters, sweepstakes, or oﬀers that may be of interest to you.

By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by sending an email to [email protected] with “Revoke Electronic Consent” in the subject line. To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Intern et access and (ii) either a printer or storage space on such device. SIGNING UP FOR COMPANY TEXT MESSAGES

Please review our Privacy Policy and Terms of Use, incorporated herein by reference, for information and notices concerning our collection, use, and disclosure of your information.

You may subscribe to receive text messages from us in various ways, such as by initiating text messages with us, providing us with your phone number, through our website, or by texting the opt-in keyword to the number we provide you. By signing up to receive text messages, you agree to these SMS Terms, NBCUniversal Privacy Policy, and Focus Features Terms of Use. We may offer multiple text message programs, and you may subscribe to more than one text message program by us. By subscribing, you understand we may send you texts even if your number is registered on a state or federal Do Not Call list. You also agree that NBCU or its agents may use any automated or non-automated technology to send you text messages.

You may subscribe to promotional NBC text messages, and you understand that you are not required to receive promotional NBCU text messages as a condition of purchasing services or products made available by NBCU.

COSTS OF SIGNING UP FOR FOCUS INSIDER TEXT MESSAGES

Focus Features does not charge you for its text message program. But message data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

FREQUENCY OF TEXT MESSAGES

We may send you an initial message confirming that we have received your opt-in. After that, the specific amount of text messages may vary depending on how you use our services and the types of text messages you registered to receive. The number of text messages you receive may depend upon factors including how you use our ser vices and whether you take steps to generate additional text messages from us (such as by sending a HELP request).

PARTICIPATING CARRIERS

Content is not available on all carriers, and carrier participation could change. Our text messages can be sent through most carriers. The content is not compatible with all mobile device models. The list of participating carriers may be changed at Focus Features’ sole discretion without prior notice Focus Features and the mobile carriers (such as T-Mobile) will not be liable for any delays in the receipt of any SMS messages or changes to the participating carriers as delivery is subject to eﬀective transmission from your carrier with active participation at that time.

ELIGIBILITY

By signing up to receive Focus Insider text messages, you represent that you are 18 years of age or older and understand the obligations and agree to the terms set forth in these SMS Terms and the Focus Features Terms of Use, all of which form binding agreements between you and us. You further represent that you are the subscriber of the cellular service at the mobile number provided or used, or that you are authorized by the subscriber to sign-up for texts.

OPTING OUT OF COMPANY TEXT MESSAGES

If you no longer want to receive Focus Insider text messages, you must text STOP, END, CANCEL, UNSUBSCRIBE, REVOKE, or QUIT to any text message from NBCU. We may not recognize other opt-out commands, and you agree that we are not responsible if you submit opt-out commands that do not comply with these SMS Terms. You must separately opt out of each number from which you’ve provided us with consent to receive text messages. If you have consented to multiple text message programs with us, you must also separately opt out of each program. After unsubscribing, we may send you confirmation of your opt -out via text message. If you have revoked consent and want to re-enroll in our text message program, you can resume your enrollment by requesting to receive text messages again through the applicable enrollment mechanism. We reserve the right to modify any number used to send our text messages at our discretion and will notify you as required by law. Please be aware that messages, including STOP or HELP requests, sent to a number we no longer operate may not be received by us. We are not responsible for fulfilling requests conveyed through messages sent to numbers we no longer operate.

MODIFICATIONS TO THESE SMS TERMS

We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be eﬀective immediately upon posting. Your continued enrollment in the Focus Insider text messaging program shall be deemed to constitute acceptance by you of such modifications, additions or deletions.
